I don’t know why people are so fearful of using AI. I agree it’s bad for creating fact patterns but it’s great for rule memorization. I tell it the rule, try and regurgitate it and it gives me a score. I have memorized more law doing this then I have the last two months passively watching bullshit Barbri videos. I can now accurately state mistake, unilateral mistake, SOF etc word for word, when a week ago I probably couldn’t even define mistake of fact. Don’t be afraid of using AI at least for memorizing, which honestly in my opinion is what we should be focusing on them next week. All of us have done at least 1,000 mbes at this point. Another 700 probably won’t make as much of a difference. I personally have sacrificed doing a bunch of mbes and instead focusing on memorizing rules and I think it will pay off.

  2. You’re a clerk for a probate judge and you have to write a bench memo for a holographic will.

MEE

  1. You think it’s a character evidence issue, but it’s really MIMIC. Also, work product doctrine and waiver of attorney-client privilege.
  2. A business associations fact pattern that you don’t fully understand. But you write about duty of loyalty and miss the shareholder proxy voting issue.
  3. Joinder. It’s a cluster fuck and you hate it but score better than you thought.
  4. Adverse possession. But also future interests and recording act.
  5. A delegation essay where you feel like you missed something, because you did. There was a standing issue. And it was worth a lot of points.

Edit: I forgot 6. Battle of the forms trap but it’s just a written agreement for services. Parole evidence issue. Or is it a condition precedent?

“I have previously received threats.”
“Related to what?”
Adrian looked at Mara.
That glance was enough.
Chen said, “Both of you need to step into the corridor.”
“Are we being detained?” Mara asked.
“Not at this moment.”
“Then we are not required to leave the residence.”
“No. But I am asking because an unknown person accurately described an object inside your apartment.”
Mara looked toward the security camera.
“Someone may have access to the feed.”
“Or another surveillance device,” Chen said.
Adrian’s expression darkened.
The detective continued. “That may create an exigency. If there is a concealed device transmitting live video, it could be associated with the attempted entry or an ongoing threat.”
Mara knew the doctrine.
Police ordinarily required a warrant to enter a home. The home stood at the core of Fourth Amendment protection. But warrantless entry might be justified by exigent circumstances, including the need to prevent imminent harm, pursue a fleeing suspect or prevent destruction of evidence.
This was not pursuit.
No one inside appeared endangered now.
Evidence might be destroyed, but not by Mara or Adrian.
The justification was uncertain.
Chen said, “I am asking for consent to conduct a protective sweep and check for surveillance equipment.”
“A protective sweep after entry ordinarily requires lawful presence and reasonable suspicion that a dangerous person may be inside,” Mara said.
“You are correct.”
“Do you believe someone is inside?”
“I do not know.”
“Then a general evidentiary search exceeds a protective sweep.”
Chen’s mouth shifted slightly.
“Have you taken constitutional law recently?”
“Painfully.”
Adrian stepped beside Mara. “We will consent to a limited security inspection for persons and immediately visible devices. No containers, drawers, documents or digital systems.”
Chen looked between them.
“You can limit the scope of consent,” she said.
“Yes.”
“You can withdraw consent.”
“Yes.”
“If we observe contraband or evidence in plain view while lawfully present, we may act on it.”
“Yes.”
Mara looked at the red file on the table.
Chen followed her gaze.
Adrian said, “Give us one minute.”
The detective’s expression hardened. “Do not move or conceal anything.”
“We are not consenting yet,” Mara said. “You cannot order us to preserve evidence absent lawful authority, though destruction could create separate consequences.”
Chen looked almost amused.
“Thirty seconds.”
Adrian closed the door.
“You are enjoying this,” he said.
“Not remotely.”
“You challenged a homicide detective on the scope of exigent circumstances while wearing my sweater and no blouse.”
“That is irrelevant.”
“It is highly relevant to my concentration.”
Mara looked down.
The sweater had shifted during their encounter. One shoulder was bare.
She pulled the fabric into place.
Adrian’s gaze followed the movement.
“Stop that.”
“Stop what?”
“Looking as though you intend to resume.”
“I do.”
Heat returned instantly.
She pointed toward the door. “Police.”
“I am aware.”
“Threats.”
“Aware.”
“Dead judges.”
“Mercer is not dead.”
“Yet your tone implied ambition.”
He almost smiled.
Mara gathered the trust instrument and Elena’s file, placed them in a document case and set it openly on the table.
“No concealment,” she said. “But no voluntary disclosure without understanding privilege and potential exposure.”
“Whose privilege?”
“My father’s former clients. Elena’s. Possibly the trust’s beneficiaries.”
“Dead-client privilege is complicated.”
“So is the crime-fraud exception.”
“Which applies only where legal services were sought or used to further crime or fraud.”
“Yes.”
“And not merely because the communication later becomes relevant to wrongdoing.”
“Yes.”
He stepped closer.
“We were interrupted.”
Mara looked at his mouth.
“Yes.”
“This remains unfinished.”
The quiet certainty in his voice moved through her.
She leaned near enough that her breath touched his lips.
“Future performance is not guaranteed.”
“No?”
“Conditions may fail.”
“I will satisfy them.”

“Strictly.”
The detective knocked again.
Mara kissed him once—briefly, deliberately—and opened the door.
The officers entered under the limited consent.
Detective Chen searched the living area while her partner checked the bedrooms and closets solely for persons. Adrian remained beside Mara, close enough that his hand occasionally touched the small of her back.
The contact appeared protective.
It was not only protective.
Each time his fingers brushed her, memory returned with humiliating clarity: his mouth at her throat, his body between her knees, the roughness in his voice when he asked what she wanted.
Mara forced herself to watch the officers.
Chen examined the security console without manipulating it.

How often is sexual assault tested on the Bar Exam?

I know the relevant rules from Evidence and Criminal Law either way.

I guess I’m just curious because, in law school, my professors made it a point to

I.) not put anything related to sexual assault on the final exams

II.) not count attendance on days that sexual assault was discussed, &

III.) put trigger warnings on the syllabus for days that SA was discussed.

I don’t imagine the Bar will be that way.

I anticipate a couple MBE questions about FRE 412-415 and *maybe* one about how statutory rape is a strict liability crime, but for some reason I highly doubt they’d have an MEE question about SA. But idk.

Nj seating voucher and accommodations

Title lmao, so I was denied accommodations this Monday!! (Lifelong physical disability from birth that’s not disputed in any way shape or form and ADHD but i guess I didn’t have enough documentation from like 5th grade) (yay 😍 lowkey ADA #violation) I appealed but there’s like no formal process so I’m just sending papers into the void

Chances of passing + Scaling

I hate to ask because I know everyone is posting these, but I’m trying to get a realistic sense of where I stand for a 270+

On first time mixed MBE sets, I usually score in the low-to-mid 60s. When I redo older timed mixed sets, I usually get 70–80%, but I know those scores are inflated because I remember a few questions. I mainly use them to see whether I’ve improved in weaker subjects under timed mixed conditions

My MEEs usually average around a 4, with some higher and some lower. My MPTs are generally around a 4 too, but I have only done about five total, including the two on the simulated exam. On the Themis simulated exam a few weeks ago, I got 58.5% on the MBE, which was extremely discouraging

My fear is that, on exam day, I score only around 60–62% (potentially worst case scenario but also knowing myself could be more than likely) on the MBE and slightly under 4 on the written portion. Taking into account the progress I’ve made this past week in my weakest subjects, is that realistically enough for a 270, or am I still too close to the line?

Also, how does UBE scaling actually work? Is it comparable at all to a law-school curve? Can scaling ever lower scores, or does it only adjust them upward? How much should someone realistically rely on scaling rather than raw practice percentages?

Seriously...I am sick to my stomach

My scores fluctuate between 50-73% daily and it's usually based on my mood. The slightest things and comments make me anxious, nervous, and it shows in my scores. I am sick of people telling me "oh at this point you shouldn't be learning, you should be doing xyz." But I know more today than I did last week.

I am usually not an emotional person, but I have never cried so much in my life. Like I feel like I can't regulate my emotions and this test is going to be the death of me. I am working my ass off and it just keeps seeming like it's not enough.

I should've been studying while I was in the womb.

Why does no one talk about how hellish this experience is????

Update: Thank you guys so much for sharing your experiences and validating how I am feeling. I took much of your advice and got a decent night's rest. I think I was going into psychosis by not getting any sleep lol.
