Looking for attorney - wage/hour violation

Yes, I know this is an unconventional way to find an attorney, thank you. After explaining my story a few times, today with a couple gals who were less than pleasant, I'm willing to take my chances

Tl/dr
My former employer stole wages from me. I have a pending case with the DOL that I'd like to secure an attorney with ahead of time, so I can access liquidated damages through court

My former employer already was found by DWS to have committed wage theft (in a separate matter) but while I thought I'd get liquidated damages, I did not. Because apparently I wasn't an employee rather a "piece-rate" employee. Because of this distinction my former employer didn't violate NM labor law but they did violate FLSA2007-7 which specifically speaks to Case Managers (my exact former title) being "piece rate" workers - therefore not employees and not covered by the Administrative exemption for OT

Also - all the other case managers who work there don't know about this OT issue, nor do they know about one of the instances of wage theft that NM DWS already found in my favor for

I'm 99.9% sure I will win the OT case. The DOL already indicated I had met every criteria they have and told me about the case law regarding case managers as well established as not being exempt from OT exemptions. They failed to keep time records (only employer my entire life who ever did this, like they literally can't produce them as they don't exist) and I have texts/calls at all hours of the day night and weekends proving I worked OT (this was part of why o left the job essentially being on call alllllllll the time).

Question First Light CU vs Nuesta

Anyone here using Nusenda? I’ve been thinking about changing credit unions since First is a customer service annoyance and I’m hoping there’s a difference.

Nusenda is behind a lot of building funding and sponsorships. They support PBS and more which gives me a sense of community involvement and First just doesn’t seem to do anything.

I know there are few ATMs for Nusenda right now but I’m hoping they’ll add more on the chest side of town. I get so annoyed with First not having cash in an ATM on a Monday morning and if you have trouble with the machine we’re just told that First can’t fix issues quickly because it is headquartered in El Paso and Las Cruces Is their “satellite” with a lower repair priority.

Today was almost the final straw when I waited in the back over 30 minutes with not one in line ahead of me being served in that time. Then, I discover that it will cost $10 to replace a lost debit card and $5 of I call in and wait in line on the phone. I simply can’t find any added value to absorb the additional fee.

Anybody having better experience with the new credit union in town?

To whom it may concern:

Due diligence has not been done in order to open Chaco Canyon to industrial development. State, pueblo, and tribal leaders say the fed’s process to open up the vast landscape to new oil & gas and mineral development is being rushed and could even be violating federal laws like the National Environmental Policy Act. Compliance with existing laws must be verified prior to opening Chaco Canyon.

The Chaco Heritage Tribal Association (CHTA), made up of Acoma, Jemez, Laguna, Zuni, and Hopi, says its cultural experts conducted an ethnographic study documenting Chacoan outliers, which include ancient roads, shrines, and ruins that hold ongoing cultural significance with Indigenous people. CHTA secretary, Aaron Sims said the Department of the Interior asked for and funded the ethonography and there’s a Memorandum of Agreement between the CHTA and DOI wherein the DOI must access it. The environmental analysis states the BLM is making a good-faith effort “to obtain the study from the CHTA, but that process is ongoing. In the absence of the CHTA study, BLM has used the best available data to inform this analysis.” The assessment states that the landscape “’has not been documented as a historic property”. Sims pushed back, “The information produced in that study is exactly the type of information needed to document that landscape as a historic property.” Before any changes to policy can occur, the DOI must access this study in order to make a balanced decision.

So my question is:

If they truly are looking out for our community and minimal environmental damage, why didn’t they implement the least environmentally destructive option from the beginning!?!

Because all they care about is optimizing their profits!

Don’t be fooled!

The New Mexico Environment Department is having a public input meeting in October over their “new less destructive” air quality plan. Represent your community’s REAL best interest. Not Texas billionaires best profit.

There’s a reason you can’t find the required environmental impact studies… try looking. It simply states “it’s part of the licensing process”.

Let that sink in

Minimum wage in New Mexico is $12/hr, minimum wage in El Paso is $7.50. So i dont think its a coincidence that most low paying jobs in El Paso start at $12/hr, theres still a lot that pay less than that, but from my job searching experience, most start at $12, coincidentally the minimum wage of New Mexico. So youre welcome El Paso
