Dealership refusing to submit forms

My husband purchased a used Tesla from United Auto Group before the September 30 deadline. The purchase price was under $25,000, and the salesperson told us we would be eligible for the $4,000 Previously Owned Clean Vehicle Credit. The salesperson told my husband that we could file for the credit during tax season since he wasn't taking the credit off the sales price.

When it came time to file our taxes, I called the dealership to confirm that the required IRS Time-of-Sale Report had been submitted. I was transferred to the finance department, where I was told they do not complete that form and that they didn't know what the form was. Instead, they emailed me the bill of sale and assured me that it would be sufficient for the IRS.

Our tax return was accepted, but the IRS disallowed the $4,000 credit because the required seller report was not on file.

I called the dealership again, and the finance guy confirmed that the credit was not taken from the sales price and that he was going to speak with the finance manager. I was told the finance manager would speak with the general manager and call me the next morning.

After two days with no response, I called back. This time I was told that perhaps the credit had been denied because we exceeded the income limits, which is not the case. I asked to speak with the manager directly. When he called, he stated that submitting the Time-of-Sale Report was not the dealership’s responsibility and that because they are an independent dealership, they do not complete those reports.

From my reading of IRC 25E and the IRS guidance, it appears that dealers selling vehicles eligible for the Previously Owned Clean Vehicle Credit are required to submit a Time-of-Sale Report through the IRS Energy Credits Online system. I also understand that dealers may still be able to submit late reports for IRS review.

At this point, the dealership is refusing to submit the report, and we’ve effectively lost a $4,000 tax credit.

Has anyone dealt with this before? Am I misunderstanding the dealer’s obligations, or is there another avenue I should pursue (IRS, New Mexico MVD, Attorney General, etc.)? Any advice would be greatly appreciated.

SOLVED Situation about Form 1099-R

Hello,

In 2024 I did a Return of Excess for my Roth IRA as I contributed too much. When I brought it up with my tax preparer, they said that the resulting Form 1099-R should be filed in 2025 and to not worry about it.

I went to a different tax preparer in 2025, and when they saw the Form 1099-R, they said it needs to be filed in 2024 and to go back to the previous tax preparer to get it amended.

Going back to the old tax preparer, they were very very adamant that it needs to be filed in 2025. Therefore, they are not willing to file an amendment.

For more info, my Form 1099-R:

  • has the year 2025 on it
  • has the code PJ on it
  • Taxable income is at ~$800 (I did a return of excess of about ~$4000, got back around ~$4800)
  • I live in CA (if that matters)

So I would like some help in determining what my next steps should be.

My questions would be:

  • who's correct?
  • what should my next steps be?
  • Assuming I don't amend, would the IRS just eventually send me a bill to pay the owed tax + penalties?

W-2 SSN was assigned to me but I am undocumented. I filed taxes with an ITIN. What do I do next?

I am an immigrant and worked an under the table job before receiving my work permit..paid in cash. I did not give the employer any of my information besides name and address. At the end of the year (2022) they gave me a w-2 with SSN on it. I did not have a SSN at the time. I filed my taxes for 2023 using ITIN using a tax preparer and reported the income from that w-2 in trying to comply with the tax law. My filing was accepted. I "owed" a little taxes due to a second 1099 job which I paid and that was all.

That said, I am now in the middle of an i-130 application with my spouse and need to report all employment for the last 5 years. I am concerned about the SSN on that job's w-2 looking like I tried to do something fraudulent. Like I said, I didn't supply the SSN. The employer handed w-2 to me and I gave it to my preparer. I didn't know those years ago the importance of the information being correct on the W-2. I wasn't trying to deceive anyone ...

My immigration lawyer is debating whether they should note this job down on the i-130. Any opinions?

W-8BEN Part II is mandatory for non-US contractor on Handshake AI

I'm a non-U.S. contractor from Egypt working remotely.

As you can see in the screenshot, Part II (Claim of Tax Treaty Benefits) is mandatory. I cannot submit my W-8BEN unless I enter:

  • Article
  • Paragraph
  • Withholding rate
  • Type of Income

I am not intentionally claiming treaty benefits, but the form won't let me continue.

Has anyone else had this issue? If you completed this form successfully, what values did you use, or was this a bug on Handshake AI?

CA State Refund went to a wrong account, FTB nor Bank won't do anything

Please help ! our 2026 CA Tax refund went to a wrong account(Our Tax preparer put a wrong account number) Unfortunately the fund processed and went to a wrong account even though the name did not match with my name.

Been contacting FTB and Bank since April. Until now still no solution.

FTB says nothing they can do since they already process refund and told me to reach out to bank to recall the money.

Bank told me nothing they can do because FTB is the one who has to do recall request.

Tax preparer told me nothing they can do because I signed the electronic file.

I been calling both since April hoping for solution but both say same thing. My co worker told me to send a physical letter to FTB and hoping for the best ? Any advise please help. Thank you so much and sorry for my bad English.

Unsolved Advice Needed: Wife is losing her job soon, should I update my taxes to reflect?

I’m going to start by saying I’m definitely not an expert when it comes to taxes.

My wife is likely losing her job around October due to a company merger. We’re planning to apply for unemployment right away, but I’m trying to figure out if I should update my tax withholding because of that.

On top of that, we’re expecting our first child in November, so great timing from the universe (sarcasm).

I have a couple questions:
- Should I adjust my W-4 when she loses her job because she may not have income for a while?
- Can I claim my wife as a dependent until she finds a new job?
- If she’s receiving unemployment, does that change whether I can claim her?

I’m just trying to get ahead of things and not mess this up.

Any help or guidance is appreciated!

Please confirm I understand this scenario regarding deductions on my rental property (in MA)

Am considering a Heloc using A as collateral which would pay off the entire mortgate of B. I want to confirm that I'll still be able to write off that interest as an expense on the rental property? Unsolved My gf's sister sold their family house how does my gf report what she got to the IRS?

So my gf, her sister and brother were all on the title for the family home their parents left behind when passing. Her sister who has taken control of handling the house has now sold it and the 3 of them split the left over money after all fees and paying off the mortgage and whatnot. How should this be reported to the IRS? my gf does not live there she lives with me and the money she received was 1/3 of the total "payout." She got the money straight to her checking account and the only tax form she has is a 1099-S which lists the entire amount before the 3 way split. Who pays the taxes on the sale, if it is her how do we submit just the 1/3 she received as she shouldn't have to pay for the full amount, or are all the taxes handled through the real estate company or something? We are both early 20s and have just been using TurboTax each year so we've never dealt with something like this. Thank you

Update: The sister has said each person will just have to pay the capital gains tax on the 1/3 amount they received. I guess next step is trying to figure out how much of it is actual gains.

Notice 2026-20 relief ends December 31. The part people are missing is what happens to lot identification on January 1.

We are are mod of r/CryptoTax and as a firm that primarily performs crypto reconciliation read Notice 2026-20 properly this week and there are two things in it that I have not seen discussed, both with a deadline attached.

JustinCPA wrote the best explanation of why your books and the exchange diverge, and why that divergence is permanent. Read that first, it is the better piece on the mechanism. This post is about the timing, which is where I think people are going to get caught.


1. The relief never let you choose your method at filing time

This is the one that surprised me. Section 4.02 says an adequate identification is made by:

Identifying, no later than the date and time of the sale, disposition, or transfer, on the taxpayer's books and records, the particular units to be sold

or by a standing order:

entered into the taxpayer's books and records before the units covered by the order are sold, disposed of, or transferred

So the relief removed the requirement to tell your broker. It did not remove the requirement to have identified the lots at or before the disposal. You cannot decide in April 2027 that your 2026 sales were LIFO.

Practically, if your tax software has had a cost basis method set the whole time, that likely functions as your standing order. What matters is that it was set before the trades and that you can show when.

If you have been trading through 2026 with no method configured and nothing recorded, the default in 1.1012-1(j)(3)(i) is FIFO, and that is already your position for those disposals.


2. What actually changes on January 1, 2027

Section 5 is explicit that you cannot rely on the books and records method for disposals made after the relief period ends.

So from January 1 you are back to the regulation: specify the units to your broker at or before the sale, or have a standing order with the broker. Do neither and FIFO applies.

Here is the part worth sitting with. The reason this relief exists at all is that brokers could not accept specific identifications. The notice says many custodial brokers:

are not currently ready to accept specific identifications (other than standing orders) from customers

and are only expected to finish building those systems during 2026.

Which means the question to answer before year end is not really about your records. It is: can each exchange you actually use accept a specific identification or a standing order yet? If it cannot, and the relief has expired, you are on FIFO there whether that suits you or not.


3. It does not cover self custody

Worth stating plainly, because a lot of people here are mostly on chain.

The relief applies only to units held in the custody of a broker. The notice says so directly. Units not in a broker's custody are governed by 1.1012-1(j)(1) and (2) instead, and nothing here changes that.


What I would do before December 31

  1. Check what cost basis method your software has been using for 2026, and when it was set. Screenshot it. That is your evidence of a standing order.

  2. Ask each exchange you use whether it can accept a specific identification or standing order for 2027, and set it if it can.

  3. Import every wallet and exchange, including dead ones. A transfer that never got linked leaves a lot with zero basis, and that error propagates into every disposal after it.

  4. Reconcile balances per account, not just transactions. If your software balance does not match the actual balance, you have missing data, and the transaction list will not tell you that.

  5. Save a lot level snapshot as at December 31. That is the opening position you carry into 2027.


One correction while I am here: the "your books control" language is in Section 4.05 of the notice, not 3.05. Section 3 is just definitions. I have seen 3.05 quoted a few times and it is worth citing correctly if you are relying on it.

I may have misread something, and the guidance could move again. If you think I have it wrong, say so and I will correct it.

Old returns not showing in IRS account, balances never posted? 2020-2021 returns

I didn't have my stuff organized as a self-employed business owner. So in 2025 I got it together. With a CPA I submitted tax returns for all previous years and paid them. I had to pay additional fees on 2022-2025. However, 2020 and 2021, which I had to submit via mail, have yet to post the fees that I have to pay, etc. (however I did pay the original balance I would've owed).

I sent it in December of 2025. It's been 8 months now, no update. I tried calling the IRS, and just get automated nonsense. My CPA also hasn't been useful.

At this point I don't know what to do. Is it just forgiven, or gone with the wind? Should I just save the estimated penalty amount ($15k USD?) in a savings account in case they ever do get back to me? I can't reach the IRS and they haven't posted it. My CPA, who I will be changing moving forward, said that they HAD called and got to the IRS but that there was a "small issue but they had received it and something is happening."

I don't even know at this point what to do.

To be exempt, you must meet the following requirements:

liability; AND
- For 2026, you expect to have no federal
income tax liability.
If you claim exemption, you will have no income tax withheld trom your paycheck and may owe taxes and penalties when you file your 2026 tax return.

  1. I claim exemption from withholding for 2026, and I certify that I meet both of the conditions for exemption for 2026. See Exemption trom withholding on page 2. I understand I will need to submit a new Form W-4 for 2027

  2. I am NOT exempt from 2026 withholding

Should I just say I am not just in case?

When the IRS-provided CSED and your software’s calculation don’t match, what do you do?

Do you rebuild the timeline manually, check another platform, call PPS, or ask someone else to review it? How long does the recheck usually take, and what do you keep in the file to support the final date?

Would an independent workpaper showing each assessment, tolling event, applicable rule, and calculation step help? Would you pay for that on a difficult case, or would it just be another report to review?

For context, I’m researching whether this problem is worth building a verification tool for. No sales pitch, links, or requests for client information.

Unsolved My accountant removed her name from my tax form I am resubmitting

I got a letter that the IRS had received a sum of money to be applied to my 2020 taxes, but no form had been submitted. They were in the same envelope, so... I don't know how that happened. But I got the form again from my accountant who did my taxes that year, and put the form in again at the end of last year when notified. I just got the form back because - ooops - I forgot to sign it. But when I was signing it and getting ready to return it, I noticed that the part under the signature, for "Paid Preparer Use Only " isn't filled in. I attached a screen shot of it and asked my accountant "Isn't this part meant to be filled out with your details?

She replied "I took off my name so you wouldn't have issues with my signatures."

I asked her what that meant, and she said "I meant having to get my signatures each time for mailing.  My electronic signature is on all the returns I've sent in for you.   I just took it off for printing and mailing purposes."

I just wanted to check in with people - is there anything shifty about this? The only reason I ask is that I've recently run into several issues with my taxes that she submitted for me. She forgot to put in one form altogether for 2024, causing me to pay an extra $1K+ a few months ago plus interest. Despite me having a robust income in 2020, she put in for several subsidies that I didn't qualify for, and also a couple of months ago I had to pay over 2K back for those.

I replied to my accountant "Ok, thanks. So your signature is definitely there on the electronic forms for 2020 that you submitted electronically?" because I figured I should have a definitive answer on that on record, in case she was trying to pretend I had put these forms in myself. Despite replying within two minutes on the other emails it's now been crickets for an hour.

Is any of this anything I should be worried about?

ETA: This is a certified accountant with an accounting firm with an actual physical office.

Retirement plan left to revocable trust, but spouse is still alive.

We've got a prospective client here who's spouse has just passed. They had 401ks spread out through several accounts. All list the surviving spouse as beneficiary except the largest (about 900k) which lists their revocable trust. I can't say I've dealt with this before, and all the reading I've done seems to be geared towards irrevocable trusts. The trust is pretty standard, everything goes to the beneficiaries outright after the second spouse's passing.

With the trust still being revocable, what are the surviving spouses options? Ideally we would like to treat as their own IRA, but I'm not sure if this is possible.

Unsolved How Can I Calculate My Net Income Bi-Weekly?

Hey there, sorry if formatting looks wonky, I'm on mobile. Hourly worker living in Georgia.

I need help understanding how to calculate what my paychecks are going to be after taxes are taken out. I was using ADPs Georgia Salary Paycheck Calculator, but I'm not sure if it's correct.

I work hourly, and am paid bi-weekly. My most recent pay period, I worked 156.31 hours. ADP calculated that I should've had about 12.79% of my gross taken by fed and state taxes. On my actual paystub though, I had about 14.11% taken by taxes.

I double checked, and all of my W4 information is correct on both the ADP calculator and on the form I filled out for work. I don't have insurance or retirement through my work, so I know it's not that either.

I'm now struggling to figure out how exactly I can calculate what my upcoming paychecks will be, since I don't understand how tax withholding work. Any insight would be really appreciated. ​

Should I wait for another letter before setting up a payment plan? Deadline is July 24

I received a tax notice saying:
“If you don't respond and/or pay $$$$ by July 24, 2026, you will receive a Notice of Assessment, including additional interest and penalties.”
This is my first time dealing with this situation. My husband tells we should wait for another letter before setting up a payment plan, but I’m worried that waiting past July 24 could cause more penalties and interest.
Has anyone dealt with this before? Should we contact the tax department now to set up a payment plan or wait for the next notice?
I want to make sure we don’t miss any deadline.

Estimated 1099 taxes if I overpaid on w-2

Worked a w-2 job earlier this year and ended up having too much $ withheld (I know that it should've been fixed but it's a long story about a not so great employer).

Now I'm contracting for a company. If I feel like enough extra was withheld from the w-2 comp for 2026 to cover the taxes I'll owe on the 1099 income, do I still need to pay estimated taxes on the 1099 income?

Is there a way to calculate exactly how much "extra" was actually withheld?
