Immigration attorney here. This one comes up constantly and a lot of people wait longer than they need to, so putting it in one place. The general rule to apply for citizenship is 5 years as a permanent resident. But there's a 3-year rule for people married to a US citizen, and a lot of eligible people don't realize they qualify. To use the 3-year timeline, generally all of these have to be true. You've been a permanent resident for 3 years. You've been married to and living with the same US citizen spouse for those 3 years. Your spouse has been a US citizen for that full 3-year period. And the marriage is bona fide, meaning a real, good-faith relationship. One point that surprises people: it doesn't matter how you got your green card. You don't have to have gotten residency through that spouse to use the 3-year rule. If you became a resident some other way and later married a citizen, you can still qualify once the 3 years line up. Everything else about naturalization stays the same, the English and civics test, good moral character, the interview. So if you're a resident married to a citizen, it's worth counting your dates before you assume you're on the 5-year clock.

I recently received my 10-year green card and plan to apply for U.S. citizenship when I become eligible.
I know that USCIS applications ask about involvement in lawsuits, so I wanted to ask whether the following situation could have any impact on a future naturalization application.
A few years ago, I served on my HOA board. A renter had a serious fall in their driveway due to loose pavers. Before the accident, the renter had notified the homeowner multiple times about the issue, but nothing was done. The homeowner told the renter that repairing the pavers was the HOA’s responsibility and claimed they had submitted a work order.
The renter later contacted me to check on the status of the request. Since I was on the HOA board, I reached out to our HOA management company to verify what had happened. They confirmed that the homeowner had submitted a work request, but they also confirmed that the homeowner had been informed at that time that repairing the loose pavers was the homeowner’s responsibility—not the HOA’s. I relayed that information to the renter via email.
The renters have since moved away, but they are now suing the homeowner. Because my emails are part of the case, their attorney has asked whether I would be willing to give a deposition as a fact witness.
My question is: Could agreeing to give a deposition as a witness in this civil lawsuit have any negative impact on my future U.S. citizenship application? I have no personal involvement in the lawsuit beyond being asked to testify about facts I learned while serving on the HOA board. I know immigration policies can change over time, so I want to make sure I’m not unintentionally creating any issues for myself. TIA!

I am a US citizen along with our 9 month old son however, my wife is a LPR who will be using the receipt notice with expired greencard for reentry. My question is can all 3 of us together go through the citizen line at customs upon reentry? The specific airport we're returning through has a seperate line for noncitizens and LPR's but I've heard that some married couples with one of them being a USC have just both gone though the citizen line and been okay. If that's the case it seems even more justified traveling with a toddler who is at the height of attachment to the mother to not split up the family. Has anyone done this or is familiar with that scenario?

Hello, Iam new here so would like some help. Recently filed(07/22) Green card application (marriage based) and H1b expires 09/02.
The uscis website says work permit/change of status takes 12 months.
Iam a lil stressed out thinking about how will i survive without working for a full year mentally (coz i love my job, architect) and potentially financially (when the savings run out)
Has anybody else gone through this process? And what did they rely on.
I know my spouse would wanna help but I think iam too independent to take the help.

I have a trip planned with my husband for next month, i’m a greencard holder and he is US citizen, we are going to our home country ( he had dual citizenship) for 10 days to get new passports, i have had my greencard for almost a year already and it will be my first time going out of the country so im really nervous about it, because everything that people’s been saying about 🧊. • 11-25-25 Got interview notice but we were on a scheduled vacation so we called to reschedule as we will be out of state. We actually rescheduled twice because the initial reschedule was still within our vacation out of state time
• 1-9-26 Did green card interview in person
• 1-10-26 USCIS portal said green card approved
• 1-25-26 Green card received in mail

Iterview process:

We were asking Claude (AI) to rehearse interview questions but worried claude would leak personal information. Our friend then built a mock interview tool for us. We used it to mock 3 times (who is this person, where did you guys meet, which side of the bed do you sleep on, etc). On the day of the interview, the officer asked 5 questions and everything went as prepared.

I've been thinking about moving to the US for a while because I'd like to build my career there and hopefully create a better future. The more I read about employment visas, though, the more confusing it gets. Between sponsorship requirements, different visa categories, and trying to understand what employers are willing to do, it feels hard to know where to even begin.

I’m hoping someone has experienced something similar.
Here is my timeline:
I received my Employment Authorization Document (EAD) through Form I-765 in September 2024 while my adjustment of status was pending.
I became a conditional permanent resident and received my 2-year Green Card in February 2025.
My Green Card is valid until February 2027, and I plan to file Form I-751 during the 90-day filing window before it expires.
Today, I logged into my USCIS account and saw that my I-765 case says it has been revoked. There is no notice or explanation in the Documents tab yet.
My questions are:
Has anyone else had their old EAD revoked after receiving a Green Card?
Is this simply because the EAD is no longer needed once you’re a permanent resident?
Should I be concerned if my Green Card and permanent resident status have not changed?
As of now, my Green Card is still valid, and I haven’t received any notices saying my permanent resident status has been affected.
I’d really appreciate hearing from anyone who’s had the same experience or knows why USCIS would do this.

Employment-based Final Action Dates, August 2026

• EB-2 India is Unavailable. U means no numbers authorized for issuance. Worth noting because the Dates for Filing chart still shows 15JAN15 for EB-2 India and people keep pointing at that one. Filing is not issuance. If you're waiting on a decision, the Final Action chart is the one that governs.
  
• EB-5 Unreserved India also went Unavailable. Barely anyone is covering this. The set-asides (rural, high unemployment, infrastructure) are all still current, so that path is open.

Now the part that isn't in the charts.

Section E of the bulletin, which most summaries skip, says this about EB-1 India:

“High demand and number use by aliens chargeable to India in the EB-1 visa category may necessitate making the category unavailable in the coming weeks if India's pro-rated limit in the EB-1 category is reached before the fiscal year ends.”

Coming weeks and not months. Fiscal year ends September 30.

EB-1 India is holding at 15OCT22 right now, so nothing has changed on paper this month. But State is telling you plainly that it may shut before the year is out.

And Section F applies to everyone, not just India. It warns that increased demand in EB-2 may require retrogressing the final action date or making the category unavailable in the coming months. EB-2 Worldwide is currently C. That warning is aimed at all of you sitting comfortably.

The detail worth understanding

Section D explains why dates have been advancing lately, and the explanation is not what most people assume. Visa issuance to certain countries has dropped because of administration actions, and the bulletin specifically cites Presidential Proclamations 10949 and 10998. To use up the numbers available in FY2026, State advanced dates across other categories.

So some of the recent forward movement isn't demand easing. It's unused numbers getting redistributed. Which is why the same section says retrogression may be necessary if demand materializes or those actions change.

Movement that comes from redistribution is not the same as movement that comes from the backlog clearing. Worth keeping that distinction in mind when a date jumps and people start making plans around it.

So, 

If you're India EB-2, nothing gets issued this month regardless of your priority date.

If you're India EB-1 with a date before 15OCT22 and your case is ready, this is not the month to sit on paperwork.

If you're EB-2 Worldwide and currently C, understand that C is a status, not a guarantee. Section F exists for a reason.

If you're weighing EB-1A as a way around an EB-2 or EB-3 backlog, it's still a much shorter queue. But the queue is real, and it's getting longer.

Anyone telling you EB-1 skips the backlog entirely is selling you a version of this that stopped being true a while ago.
