Kentucky has an interesting conundrum. They passed a law to limit the governor's power, but did not change their state constitution. Their state constitution gives him power to appoint someone until a special election can be held.
They're delaying so he can't appoint someone. This is also I think why we're hearing rumblings of Fettermen switching parties- Republicans are in danger of losing the majority. Fetterman would boost their number to account for an appointed Democrat

Just a reminder; Andy Beshear is a dem governor in a bright red state. He has to be extremely careful in moments like these, because many of his voters also voted for Trump and McConnell.
He will make a move closer to the deadline, but not immediately or rashly.
He also might be a decent shot to contest the seat himself in 2028.

First, which seat is more important - the governorship of Kentucky or a Senate seat?
Second, Beshear could easily beat this drum with the message of: "Kentuckians need a functioning Senator and they deserve truth and transparency." Popular, nonpartisan, effective, and indisputably legit message.
Instead, Beshear is just kinda... waiting for the other shoe to drop? Waiting for a committee of political consultants to A/B-test various messaging campaigns? Giving his genteel Republican colleagues a chance to respond, and a possibly-alive McConnell space to deal with his health issues in dignity? Totally passive.
If the parties were reversed, the GOP would already have a fast-tracked petition pending before SCOTUS.
Once again, Democrats are playing softball and letting the GOP run circles around them. Big JV energy here. I presume that Schumer is waiting for the Baileys to express their opinion to him.

Funnily enough, the governorship for Democrats.
Because of Kentucky Republicans, Bashear has his power limited, including on replacing congressmen. So he, technically, can't just nominate and appoint anyone by law. Even though the state constitution was never changed to allow that law, any challenge in the courts will not be quick and that's even IF they rule in his favor. He's a Democrat governor in a deep Republican state.
So, Special Election it is. Well that will likely result in a new Senator that is just as conservative, or even worse (IE more MAGA hardliner), than McConnell was, because again Deep Republican state.
So either way, it'll likely just be a loss no matter what.
Ironically enough, doing nothing IS the smarter play. Even if it's being made unintentionally. A seat left vacant by McConnoll's absense is a guaranteed No-Vote. Empty chairs don't vote after all. That means one less vote for Republicans, and specifically Trump's* (because they're one in the same at this point) agenda in a majority that was already slim and had been getting slimmer by the day. Similarly not actually making much of an effort to prove McConnell is alive means the Republicans leave that seat empty for longer.
So even if it's coming from a lack of fight, Bashear's passiveness is much more beneficial for the Democrats in the Senate than if he actually made an effort and likely give the Republicans a replacement for McConnell (or forced a, albeit unlikely, living McConnell back) into DC.
