All a landlord is entitled to know is "employed = yes".

Not where, what or who you work for, nor any other conditions that are between employee/employer.

Charging more for WFH is discriminatory and illegal.

Unless you are specifically work from home because of a disability where the ADA would get invovled, then its not illegal

100% illegal to charge more based on WFH.

Are you going to charge more if someone cooks with the stove vs. gets takeout too?

What about someone who uses a hair dryer, and someone who doesn't. If I don't use a hairdryer do I get a discount?

What if I only work from home 2-3 days a week?

Not all discrimination is illegal. WFH status isn't a protected class, as far as I know. Unless you have a better source for that?

If both parties agree to this term in a contract, then yes, it may also be legal.

Edit: Senate Bill No. 611 in California may cover this for California residents.

So what if your work conditions change- you are let go and spend your time at home using electricity to look for jobs and pee - do you now have to pay more?

What if you switch employers where they were in-office and now WFH- do you pay more then?

This is a super shitty landlord.

I agree it's shitty. There's no good reason to do this - it's just raising the rent without needing to disclose it in the headline of the ad. Basically false advertising. Why not just charge $4/month rent, and a $2996/month "breathing on the premises" fee. It's stupid.
