You absolutely can. My apartment that I just moved out of charged an app fee and I was not employed for the majority of my time living there.

Unemployed while there ≠ unemployed during application. The fact that you didn’t just say that implies that you were being intentionally deceptive and now when you say “well ahckshually I was unemployed then too” we will all know you’re lying because you would have just said that initially.

Based off of what? What evidence do they have that you are working? Living in an apartment 8-5 doesn't constitute proof of working.

This image is unenforceable is my only point. It's an honor system where you choose to be over charged.
