I am not an attorney or law enforcement official.

Our first person witnesses need to speak with attorneys before testifying to law enforcement.
Some of our witnesses are U.S. police officers, and U.S. military personnel (among others).

Who can I contact?

Our witnesses will need U.S. attorneys to advise them about:
- Witness Protection for persons testifying and their families 
- Plea bargains and sentencing reduction 
- Immunity from prosecution in exchange for their testimony 
- The UCMJ (Uniform Code of Military Justice)
referencing Treason Against the United States 
- Class Action lawsuits 

We have criminal perpetrators and witness survivors with knowledge of multiple categories of felony crimes.
Witness protection is crucial, some of our witnesses have first person knowledge of extremely emotional crimes against human beings — including young children.

The Problem:
The San Antonio Texas Police Department (SAPD), and the Bexar County Sheriff’s Office (BCSO) refuse to help our witnesses.

A while ago I posted here about a Utah GRAMA dispute involving records that a state licensing agency received from a private treatment provider, relied on during its investigation, and then argued were not agency records because they were “owned” by the private provider.
I wanted to provide an update.
I appealed, and I won one of the key records I was seeking. The agency has now been ordered to release the employee personnel action form that I argued was a government record.
While I’m glad I prevailed on that issue, the process has only increased my concerns.
Throughout this case, the explanations for why records could not be released have changed multiple times. At different points I was told:
the records weren’t agency records,
the records were private,
the records weren’t retained,
and in at least one instance, after I challenged the response, the agency later acknowledged that a responsive record actually existed.
Separately, another agency reviewed unredacted records in camera during my appeal, and the reviewing official stated they would conduct a de novo review to determine whether the redactions were properly applied instead of simply accepting the agency’s position.
I’m trying to keep an open mind, but the combination of changing explanations, successful appeals, and records appearing after initially being unavailable has made me wonder whether this is more than an ordinary records dispute.
To be clear, I’m not claiming I have proof of a cover-up. I don’t. But from my perspective, the circumstances have made me question whether there has been an effort to avoid full disclosure.
Has anyone here dealt with a situation where:
the rationale for withholding records kept changing,
records appeared after they were initially said not to exist or not to be agency records,
or successful appeals revealed that an agency’s original position was incorrect?
If so, what did you learn? Did it ultimately turn out to be an ordinary records dispute, or did it expose larger problems with how the investigation or records requests were handled? I’d appreciate hearing from anyone with experience in this area.

I requested some information via FOIA/Secure Release from CBP and noticed my status changed from "Searching for Records" to "Processing" a few weeks ago. Any idea on what this means?

Hi. :) I've visited the US five times now on a tourist visa, been taken to secondary twice as a result of my age at the time. I filed a foia (CBP) as a few months ago my husband filed an I-130 consular application for me and I wanted to keep all my records close to me but I got this response sent to me 'Closed (No Documents Sent)'. There's no closed notice, explanation, just that. I submitted my I-94 no, and a scan of my passport. Transparency Update: Tips for Obtaining ALPR Records

If you want to know more about how your comings and goings might be tracked by ALPR cameras, where do you start?

So recently I noticed something weird on one of my FOIA requests through NTSB's PAL portal, my fee waiver justification looked like it got cut off mid sentence when I went back to check on it. I also noticed this same exact issue on the DOC's PAL.

wasn't sure if I was misremembering what I had done so I used dev tools to poke around the PAL. Found the actual textarea has maxlength="2000", so it lets you type way more than what I was actually seeing. But then I downloaded the full page and searched through it, and the text that actually got saved stops dead at exactly 255 characters. No error, no warning, nothing, I t just quietly drops everything after that.

For reference, FOIA.gov's own website says this field is supposed to support up to 10,000 characters. So what's actually happening is, the PAL cuts off request at 255 characters, but allows 2000, meanwhile foia.gov allows up to 10 thousand.

I checked this on both DOC and NTSB's portals and got the same result on both, and they both seem to run the same PAL platform, so this might be affecting a lot more agencies than just these two.

If you've ever written out a detailed fee waiver on a PAL based portal (or to one that uses a PAL based portal), it might be worth double checking it actually went through in full, because this could easily be why some waivers get denied or ignored without any real explanation.

Already notified some agencies about, but wanted to see if anyone else here has run into this or has more insight into this issue.

Also I'm still relatively new to all this FOIA stuff so if I'm misunderstanding something or got a detail wrong, feel free to correct me or add information. Just wanted to get this out there in case it's affecting other people too.

EDIT: I have confirmed the truncation is VISUAL ONLY (as an email directly to the agency had proved they had the full waiver), this still dosent exactly explain the 10000 vs 2000 character limit stuff, plus the fact it is still being truncated visually, but it wasn't as major of an issue as I believed it to be.

In Illinois, when a FOIA request is denied by a public body, the Public Access Counselor's Office and the courts are the only two options for possible resolution and eventual release of records to the requestor.

I recently submitted a two part FOIA to the Public Access Counselor's Office. I received no records, nor did I receive any actual citation of legal exemption to withhold the records, because they suggested my request was "unclear" and thus, no records to be released.

Illinois mandates all FOIA Officers to successfully complete training designed by the Public Access Counselor within a specific time frame, including FOIA Officers with the PAC Office.

Here's the exact verbiage I used for part 2.

"A copy of all FOIA Officer certifications for all FOIA officers working with the PAC office for the last 3 years, including any renewal certificates."

Now, one reality of the whole FOIA principle, no matter what public body you request information from, there is no firewall available to prevent the invention of an improper reason to deny the request. Sure, there are what appears to be fairly clear exemptions to the principle that all government records in all forms are of the public domain, but a refusal to release is a refusal to release.

Imagine my disappointment when I received the following rabbit hole:

With regard to Part 2 of your request, it is unclear whether you are seeking copies of training certificates completed by the Office of the Illinois Attorney General's FOIA officers or all FOIA officers who have completed the training curriculum developed in a three-year time frame. Please be advised that this office does not maintain or possess copies of the certificates of completion issued to FOIA officers outside of this office. Those must be obtained from the individual who completed the training or from the public body upon which he or she serves (5 ILCS 120/1.05(b))

I know I was not hallucinating when I read this, but it certainly made me wonder if the response was created by AI, because at least there could be a rational for that first sentence (blaming it on the tech, not the human).

I used 25 words total in my request and almost half of those words were used to provide the parameters of the request for "A copy of all FOIA Officer certifications (noun) for (preposition) all FOIA officers working with the PAC office for the last 3 years (adjective defining the parameters of the noun)".

How the heck does that get distorted into a moment of confusion driven by a suggestion that those words represent "all FOIA officers who have completed the training curriculum developed in a three-year time frame."

Even this sentence structure is confusing. Are they saying the training curriculum was developed in a three-year time frame? Is it a figurative dangling participle suggesting there is yet another interpretation of my 25 words that was left off?

Anyway, here's closer to my point of posting. Right now, I have a response I intend on sending Monday on the foundation of attempting to work with the public body I requested from.

If they reject my interpretation of their denial that does not contain an actual citation of exemption other than "We're confused," then I have two choices.

Request the Public Access Counselor's Office for a formal Request for Review, in which it seems like it would trigger a conflict of interest as you can be sure that the PAC Office is not going to court against itself to compel it to the release of records.

Other option is to enter a courtroom and ask a judge to come to their own conclusion as to whether or not the response lived up to the standard of "clear and convincing evidence" showing the PAC office was legitimately and in good faith confused with my choice of words.

I am curious as to what people believe would be the more effective path to challenge this particular rabbit hole of a denial against the very public body with state statute authority to mediate between these types of circumstances.

Hello,

I’m trying to get access to the body cam footage for a friend whose son was found deceased. When I helped them submit the request with the police station, the request was denied stating it was “exempt” from disclosure. They also completely redacted the report of the incident, to the point the detective said he’d never seen it in his nearly 40 years. My friend is/was his next of kin and received his ashes and tox report directly from the police.

How can I help my friend get this, for peace of mind?
