I had a friend in this situation. Got fired as a teacher for it and still wouldnt take him back once exonerated. Year and half of the woman failing to get her key witness to show and snapchat subpoena came through.

Hes fine now and moved and working somewhere else, but the damage was done and miserable for year and half.

Really sucks and damages true situations

Being a victim of this, its absolutely fucking horrific.

Ex partner of 20 years went full fucking evil because I went for custody of my kids due to her neglect. She very early pushed me to suicide over it. Its not just the police that are involved. Its fucking everyone... from your friends and family having to deal with it down to the mums at the school giving you evils because theyre convinced you're a monster

Trying to take someones freedom with lies like that absolutely should have severe consequences, it really really messes your head and relationships up.

All I can say is this is something I will never recover from. It went on for 3 years with reminders every single day. She still does shit even now.

Its physcological and emotional abuse..which are often just as bad as sexual abuse. So it absolutely can be worse than rape, depending on the outcome.

If I had gone to prison for years over it, which people have, id go as far to say rape is nothing in comparison to that.

You're not looking at the whole picture.

Usually people recover psychologically from assault, but it depends on severity and frequency. You don't get years of your life back if wrongly sent to prison.

MOST people recover from traumatic experiences. Not everyone gets raped, but everyone experiences trauma in their lives. I know if I had to choose between getting raped or spending a decade in prison I'd choose the former. Hell, I'd probably get both if I went to prison anyway.

Nope. It's true. Rape is horrible, a violation of your body. It is also by nature private. No one will know about the violation unless you tell them.

Rape accusations are a violation of your mind. And body, being arrested in the middle of the night from the comfort of your bed, shoved into a police car in your underwear, and you did NOTHING. You were living your life. They are also extremely public. You are forced into a public, violating display, by the judges and police and the accuser. You have no chance of your most humiliating and violating moment being private. Instead, you will be paraded around, and the general public will gleefully join in on your violation. You will not be considered a victim of violation, but a perpetrator. Public opinion will continually violate you. You have no escape, even after being proven innocent.

The problem is that risks preventing real victims or witnesses from coming forward, because they're afraid of being accused of making a false claim if the defendant is found not guilty. There's no perfect solution here. 

Edit: downvote me all you want, but I've yet to hear a good solution to this problem.

Demonstrably false, not just unproven claims. It should be shown that the false claims were intentional before any punishment. But there should definitely be a layer of justice when it's proven in court that claims were not just unproven, but false. Should apply to cops especially.

Somewhere along the line, perjury became an unpunished crime.

For a victim who may be seriously injured, drugged, traumatised, or otherwise have their rational thinking affected, it's not inconceivable they might not think to go to the police so evidence can be collected within the first few days after the incident. 

Besides, the presence of DNA evidence would only prove that they had sex with that person. It wouldn't prove if they were a consenting partner.

Same tired argument as always, the answer to that is that any arrest, charge, or conviction of making a false allegation would require evidence that the claim is false.

Was the claim impossible to have happened? Is there text messages where they admit to fabricating the claims? Etc, etc. Nobody is saying this would or should happen just because the original claim comes back not guilty

That's not going to solve the problem. Witnesses will still be be too afraid to testify if they know that if they make a mistake or misremember any details they'll be opening themselves up to being accused of fabricating claims.

But again that is not what is being said. we are talking actual physical evidence that it was a malicious attempt to attack someone.

For example Elanor Williams (https://en.wikipedia.org/wiki/Eleanor_Williams_(criminal)) in her case the police found that in one of the eight allegations she made (the second FYI so she went on to do the same to six other men after) messages that she provided as evidence to incriminate the victim were in fact sent from an account she set up from the WiFi at her mothers house.

For her sixth allegation CCTV footage and records from the hotel she was staying in directly contradicted her story in a way that would be impossible to simply be misremembering.

She later alleged she was attacked and raped by multiple men and beaten with a hammer, however evidence showed she purchased the hammer herself and the exam by doctors identified the injuries as self inflicted.

The consequence of her campaign of false allegations was multiple attempted suicides, multiple racially motivated attacks (she claimed to have been trafficked by asian gangs), and vandalism against the victims houses and property. She directly and deliberately put the victims of her lies lives at risk and for several of them caused permanent irreperable harm.

Why shouldn't she face consequences for that?

Then where is the line? When does it cross into enough evidence for you? Because your earlier points did not seem to support the position there is ever enough evidence.

At this point you are either misunderstanding or misrepresenting what is being said. This isn't about someone misremembering the exact details, this is about there being evidence of a timeline laid out.

Take the hypothetical, person A decides to accuse person B of raping them. So to set up their story they send a text message to a friend saying that person B raped them last night.

Two months later they report it to the police. During the investigation it is discovered that a week either side of the alleged offense person B was in a different country.

In this example they are not misremembering or misspeaking, the text message lays out a clear timeline. Even if we gave them a degree of benefit of the doubt and said trauma could have led to them saying it wrong in the text message the timeline is impossible to have match up.

As I have said repeatedly this is about sufficient evidence, a single misremembered detail would not by itself be sufficient evidence sure. But that isn't all that can possibly exist

Have you checked the conviction rate for rape? In most countries it's under 10% because of the extremely high threshold of evidence needed to secure a conviction. You'd struggle to argue the system protects alleged victims.

That's certainly a possibility. It's equally possible that the majority of cases just have no conclusive evidence either way. If the assault happens while the victim is alone with no witnesses it's extremely hard to prove anything.

Yes, it is indeed a possibility. Moreover, it is a much higher probability than you suggest because if an assault takes place there will normally be some DNA evidence, signs of struggle etc even if a victim was alone.

Signs of a struggle might not be evident if the victim was drugged or otherwise incapacitated. DNA evidence would at best identify who the other person was but wouldn't be enough to conclusively prove if it was a consensual encounter or not.

There is all kinds of evidence. For example, unexpected drugs in the victim, sperm inside the victim, perps skin under victims nails. Who knows, I am not CSI but I expect there would be some evidence if a person were to be convicted. That said, the burden of proof is beyond reasonable doubt… so, respectfully, it is pointless saying a particular incident might not have conclusive proof - that is basically a not guilty scenario anyway… where the “victim” “could” still be a false accuser.

I feel like we're getting side tracked debating the validity of any one type of evidence. The point is it's entirely possible for a rape to occur without producing evidence that meets the threshold required for a guilty verdict. That's why the conviction rate tends to be so low, and why we should be extremely hesitant to assume that the victim fabricated their account in the absence of evidence that they did.

They’re right though, I do NOT condone falsely accusing anybody of rape. It’s a fucking joke, lives get completely ruined, from the accusation alone. It’s one of those crimes that’s never truly innocent before proven guilty. Guys are always proven guilty.

The problem is just because you can’t prove someone is guilty of rape beyond reasonable doubt, doesn’t mean that it definitely didn’t happen, or that automatically the person who made the claim was making false accusations why isn’t reasonable doubt. It’s such a slippery slope to go down.

This happened to my brother. He had a girlfriend, she had met our family and everything. Turns out she already had a boyfriend and she was seeing my brother while the boyfriend was working away. Boyfriend found out and you can guess what she claimed. Fortunately, a litany of messages, photos and family witnesses stopped an innocent person from going to prison.

This situation still doesn't alter the fact that too many guilty rapists get away with it, though.

A girl I rejected once accused my friend of this. The thing was since I was there that night she says he did I know it's a lie.

She didn't try suing or nothing. But it seems she claimed this so I'd get upset or something. It was weird. She only said this to me and another friend of mine

But as I said he was literally with me the entire night as we were drinking, he passed out on my couch. It was literally impossible for him to do this

I had a female landlord who decided she didn't want to rent to me anymore, but I had a lease. She told me that I could either move out, or she'd call the police and tell them I attacked her. As a man, I have no defence against an accusation like that, and the police will automatically believe the accuser. By the time the truth is sorted, my life would be ruined. I just got my shit and got out.

But the caption definitely makes me think OP is some weird manosphere rape apologist. The bias is definitely against victims of rape in the majority of cases. The implication that there is an epidemic of “false accusations” is the opposite of the truth. The truth is that the vast majority of rapes and sexual assaults go unprosecuted.

Hong Kong’s security bureau said in a letter to media in April that Rose’s initial rape claim was “duly investigated”, but that the investigation found evidence that contradicted her account.

i.e. There is evidence that says the rape didn't happen.

From what I can gather reading other sources, the evidence is that she deleted some texts, and used disappearing messages on WhatsApp. I've not found anything that states something more conclusive.

It does look like a "he said, she said" situation, and while there doesn't appear to have been enough evidence to convict the guy, it doesn't look like there was enough to convict her either, certainly not by UK standards.

False claim ruin someone life, those accusation even if disproven will follow him all his life, impact his job opportunities too.
What about the damage she have done for the women that actually got raped? There is sadly countless of them out there, that lived trought something traumatising, she didn’t think twice trying to lies about it to get some money ,not caring about the damage done to the case of women that did get raped.

In this case, probably yes. I mean she totally fucked up by trying to blackmail him, so we don't know what would have happened if she hadn't, but it's not a clear cut case like OP is implying.

I didn't follow the trial, and I haven't done any research into the case, so I'm not going to comment on the evidence itself. I just hope it truly was a case of blackmail and that she wasn't actually raped.

At the same time, I hope cases like this don't discourage genuine victims from coming forward out of fear that they'll be dismissed as making a false accusation or even face punishment. From what I understand, the key issue here seems to be the alleged blackmail, not simply making an accusation. Hopefully people recognize that distinction.
