In August 2025, my partner and I moved into a house owned by my partner's brother. Move out was May 22-24th, professionally cleaned on May 26th, and final walkthrough was done on May 30th, but the lease didn't end until June 30th. This is his first time renting the property, as until we moved in, him and his family still lived there. At move in, my partner and I were actually helping clean out the cabinets, pantry, fridge, and the garage. The garage in fact wasn't usable for about a month as they slowly removed property, and in fact some items were left behind and still there when we vacated in May. A cleaning service was performed, but no painting or prep was performed for our start date otherwise. That said, we accepted the house in that condition, but even then, we told ourselves that he had better remember that when it came time to move out. I don't think I'd be typing this if he had.
The security deposit was one month, plus $1250 as a "pet security deposit". My partner was starting his own pet related business in the house, and his brother was fine with that, just so long as there was extra payment to cover any damage to the house. A generic 6 month lease provided by his listing agent was signed, and we moved in. Virtually all correspondence was done via text message, and all payments via Zelle. The house is on a zero lot and soon after signing the second lease in the winter, the neighbor had some drainage issues. It was then that we were informed that all houses in this neighborhood have a sort of easement into the next door yard, for drainage and wall maintenance. My partner and I decided that this house would no longer work for us and his business, as he has boarding pets and working dogs in the yard at random times, and being forced to leave the gate unlocked or be home to open it at any time didn't work for us. So we found another home.
The other night, after reminding him to please send over the deposit minus deductions, I received a Zelle payment of $1050. So I asked for a list of deductions, as that was far lower than expected. He listed painting at $1000, carpet replacement at $1000, tree removal at $450, cleaning fee at $250, and hardware replacement at $50.
Before moveout we had all of our belongings packed up, and the paint professionally matched. We sparkled every hole and painted every spot that we put on the wall since move in. The only part we didn't get was days later at moveout, when removing a particularly large and heavy piece of furniture, we did put some knurly paint chipping on door frames getting it through the narrow hall way. We already had the walkthrough scheduled, and I didn't already have a paint matching the trim, so I let it be. Like I said previously, holes and screws were left in the wall when we moved in, and I left those as I didn't see them as being my responsibility. I have photos from move in showing these screws and damage.
He decided to replace the carpet in one of the bedrooms (and may have actually done both) because he claimed there was a pet smell. Now I don't argue that we had pets in there, but the room in question was a guest room for our tenancy, so it certainly wasn't often. My issue isn't that were being charged, but that $1000 seems high for a carpet replacement on used carpet. (I have photo of move in at hole in the carpet in the center of the room.). By his own admission, that room has had water damage before (neighbors outside wall and atrium border that bedroom) and personally I'm not sure that isn't what was creating the offending smell.
His landscaping consisted of sage bushes and juniper trees in front. The lease covered the basic landscaping, but not tree removal. He claims that the sage bushes were allowed to get big enough to push the tree into a lean, making it necessary to remove the tree. I have a difference of opinion on that as well since the tree was leaning towards the road, but the push was at the 90 degree angle to the way the tree leaned. I believe that at some point all the limbs were removed from the house side of the tree to gain access to landscape, and that made the tree heavier on the opposite side causing it to lean. I had a bright yellow ratchet strap hooked to the tree for six months staked into the ground trying to mitigate the damage. While I never informed him directly of the issue, I did think he was aware, as he stopped by several times to pick up packages at the front door while we lived there. This charge I think I'm fair to dispute completely.
We had the house cleaned professionally on May 26th, just prior to walk through. He said that since work had to be done that they needed it cleaned again, and that we had cleaning done prematurely. I also don't think I should be held responsible for cleaning charges incurred after we had moved out.
The hardware, I can accept responsibility for, as I had little time to address it. Landlord had a sliding gate installed between two rooms at a half wall. When the cleaning crew was cleaning, the latch was knocked through the sheetrock into the wall. I did attempt to fix it, but was apparently unsuccessful to his satisfaction, as he had to change the placement of it altogether.
So, all that to say, would you simply accept this as lesson learned to keep the peace in the family and keep being invited to Christmas, or would you go back and argue for more, or skip it and go to court? Is this even a court matter?

Small update. As I got off work this evening he sent some text messages. Basically he says that after looking at the photos from move in he realizes the shape the house was in and decided to cut the paint deduction by half. He has also decided not to charge for cleaning since that was cleaning his mess and not mine.
Then he says that he will be charging for unpaid water bills, and landscaping maintenance after move-out. He then sent $250 via Zelle.
At the time of move in, the water utility was skipped over by both parties. On August 25th I asked him how was the water bill done. He told me he would get an email and forward the amount in the form of Zelle request. In the 10 months I lived there, he sent a request twice. Both were promptly paid. Now I'm not above paying my dues, but I would have preferred to pay these at the time of processing, not coming out of the security deposit.
As for the grass maintenance after move-out, I did ask him if they could take care of the lawn after we left so that I didn't have to haul a lawnmower back and forth to take care of it, but if he wasn't comfortable with that, I would figure it out. He said he'd take care of it, as long as I kept stopping by to water the grass. No payment was discussed at that time. I haven't responded to his messages yet.
