I-140 | Employer-based I140 approval times
Hello, I recently saw posts about I140 being approved in less than a month, I also saw some posts about Premium I140 filings that have been pending for over 70 days.
My employer is about to file I140 should I advise them to go premium filing route or normal? Any way we can find recent trends for i140s?

I-140 | Employer-based I140 and I485 Concurrent Filling
I have an approved PERM and have filed my I-140, I-485, EAD, and AP concurrently. I am from one of the 39 countries on the travel ban list. Has anyone from these countries recently had their I-140 approved under regular (non-premium) processing? How long does it typically take to receive approval for the I-485, EAD, and AP? Thank you.

Approved | I-140 EB2 or explore EB5
Currently on EB2 with Priority date in late July 2015 India. The current DOF is in Jan 15. Really frustrated not able to travel back home to visit parents and have about 1.8M NW. Been in the country for nearly 20 years. Since there’s not much time left for EB5( sept 2026) should I consider EB5 route at all or wait for EAD ? Not sure how long that is really going to take. Trying to get some help from the community

Visa Bulletin August Visa Bulletin is out. EB-2 India is Unavailable, and EB-1 India might be next
Employment-based Final Action Dates, August 2026
| Category | All Other | China | India |
|---|---|---|---|
| EB-1 | C | 01JUL23 | 15OCT22 |
| EB-2 | C | 01SEP21 | U |
| EB-3 | 01SEP24 | 01JAN22 | 01JAN14 |
| EB-5 Unreserved | C | 01DEC16 | U |
- EB-2 India is Unavailable. U means no numbers authorized for issuance. Worth noting because the Dates for Filing chart still shows 15JAN15 for EB-2 India and people keep pointing at that one. Filing is not issuance. If you're waiting on a decision, the Final Action chart is the one that governs.
- EB-5 Unreserved India also went Unavailable. Barely anyone is covering this. The set-asides (rural, high unemployment, infrastructure) are all still current, so that path is open.
Now the part that isn't in the charts.
Section E of the bulletin, which most summaries skip, says this about EB-1 India:
“High demand and number use by aliens chargeable to India in the EB-1 visa category may necessitate making the category unavailable in the coming weeks if India's pro-rated limit in the EB-1 category is reached before the fiscal year ends.”
Coming weeks and not months. Fiscal year ends September 30.
EB-1 India is holding at 15OCT22 right now, so nothing has changed on paper this month. But State is telling you plainly that it may shut before the year is out.
And Section F applies to everyone, not just India. It warns that increased demand in EB-2 may require retrogressing the final action date or making the category unavailable in the coming months. EB-2 Worldwide is currently C. That warning is aimed at all of you sitting comfortably.
The detail worth understanding
Section D explains why dates have been advancing lately, and the explanation is not what most people assume. Visa issuance to certain countries has dropped because of administration actions, and the bulletin specifically cites Presidential Proclamations 10949 and 10998. To use up the numbers available in FY2026, State advanced dates across other categories.
So some of the recent forward movement isn't demand easing. It's unused numbers getting redistributed. Which is why the same section says retrogression may be necessary if demand materializes or those actions change.
Movement that comes from redistribution is not the same as movement that comes from the backlog clearing. Worth keeping that distinction in mind when a date jumps and people start making plans around it.
So,
If you're India EB-2, nothing gets issued this month regardless of your priority date.
If you're India EB-1 with a date before 15OCT22 and your case is ready, this is not the month to sit on paperwork.
If you're EB-2 Worldwide and currently C, understand that C is a status, not a guarantee. Section F exists for a reason.
If you're weighing EB-1A as a way around an EB-2 or EB-3 backlog, it's still a much shorter queue. But the queue is real, and it's getting longer.
Anyone telling you EB-1 skips the backlog entirely is selling you a version of this that stopped being true a while ago.

I-485: Adjustment of Status I485 j question
Hey everyone
Congrats on seeing movement in the august visa bulletin.
My question is about i485 j i submitted my documents back in April however it got rejected due to payment issue and my entire package was returned. Now my PD is current and I will resubmit the same package but my question is do I submit everything from April as well as i485 j that has my employer signature from March or do I obtain a new i485j from my employer with an updated signature and recent date?
Thank you

Visa Bulletin August 2026 Visa Bulletin is out: EB-1 India could go "Unavailable" in the coming weeks, plus a new worldwide EB-2 warning
The State Department released the August 2026 Visa Bulletin. Key points for employment based categories:
EB-1 India
- Final Action Date holds at October 15, 2022 (no change from July).
- New warning: State says high demand "may necessitate making the category unavailable in the coming weeks" if India's pro rated EB-1 limit is hit before the fiscal year ends September 30. Last month the language was "coming months," so the shift to "weeks" stands out.
- EB-1 China advanced one month to July 1, 2023. EB-1 stays Current everywhere else.
EB-2 (new worldwide warning)
- July's retrogression warning was China specific. August drops the country limitation and now warns the entire EB-2 category could retrogress or go unavailable in the coming months.
- The chart itself is unchanged. EB-2 is Current for all countries except China (September 1, 2021) and India (Unavailable). That includes EB-2 NIW.
India
- EB-2 and EB-5 Unreserved remain Unavailable, unchanged.
- August does not repeat July's projection that these would likely reopen around October 2026 for FY 2027.
Where things advanced
- EB-3 (most countries) moved from August 1, 2024 to September 1, 2024. EB-3 China moved to January 1, 2022. EB-3 India and Philippines unchanged.
- EB-3 Other Workers advanced about a month to April 1, 2022 (China to May 1, 2019).
- EB-4 and Certain Religious Workers advanced to October 15, 2022 for all areas.
Dates for Filing
- Nearly identical to July. Only change is EB-3 China, up one week to January 8, 2022.
AOS filers: USCIS is requiring the Final Action Dates chart for adjustment of status in August.
Anyone with an India chargeable EB-1 priority date before October 15, 2022 planning to act on final action before September 30? And is the worldwide EB-2 warning changing anyone's NIW filing timeline?

Priority Date Evaluate my Likelihood - Feb 2015
I'm an indian college student, parent's priority somewhere around late February 2015 so more than likely the charts need to show March for me to file. I turn 21 in March 2028, but because of CSPA I might get close to another year. Also if I'm not wrong, isn't filing the i-485 determined by the Final Action chart now? Please correct me. Any idea when my priority date might become current?

Priority Date October 15 priority date
Basically the title. I have a child who is 16 now and will turn 21 in early 2031. Do you think that there is a realistic chance that we will be current by then? Also, do think table 2 will become current in FY 2027?
