My cynical take is that perhaps the somewhat muted response right now from the VA Democrats is that they will amplify it more towards the mid terms as an issue that is still alive and requires massive funding to fight.

Virginia lawmakers this year set out to bar out-of-state National Guard troops from entering the Commonwealth without the governor's consent, a move to push back on President Trump’s federalization of the Guard in other states. Lawmakers ultimately established a study group, tasked with recommending how the state should respond if it happens.

Lawmakers also debated the limits of an armed citizenry, banning assault firearms and high-capacity magazines, effective July 1. The ban has barely functioned since, tied up by four lawsuits and a statewide injunction that has left a popular public safety measure unenforceable.

In 1776, Mason drafted the Virginia Declaration of Rights. Section 13 of that declaration said “a well-regulated militia, composed of the body of the people, trained to arms” was the “proper, natural, and safe defense of a free state.”

But Mason's clause protected only a collective interest, the state's ability to maintain an armed militia. It did not guarantee an individual's right to own a gun. That changed in 1971, when Virginia amended Section 13 to add, "the right of the people to keep and bear arms shall not be infringed." That's the moment gun rights and militia rights became legally braided together in Virginia, and why untangling them in court today might be difficult.

I have young kids and recently inherited a few antique firearms from the 19th century (black powder) that are in pretty poor condition but I think look cool and want to hang them in my man cave as decoration. I'm worried I could get in trouble by having these firearms not locked up because of kids in the house. I don't believe they're even operable given the age and condition, and I don't own any black powder or relevant ammunition to shoot these guns regardless. All of my modern firearms that I actually shoot are locked away at all times.

Is this something to worry about?

If you have any recommendations, please DM me. The person doesn’t necessarily have to live or work in Virginia as long as they’re willing to travel to court for trial (don’t want to say exactly where but it’s closer to DC than Richmond). Strong preference for someone who’s testified before, but not required if they’re otherwise super well qualified.

Hello, I submitted a form 1 to SBR an 80% AR-15 Lower on 5/1/26... it just got approved today, 7/23/26 with the following conditions:

FIREARM MAY NOT BE CONFIGURED IN VIOLATION OF VA. CODE §§ 18.2-308.2:2, 18.2-287.4:1 (PROHIBITION OF ASSAULT FIREARMS), UNLESS POSSESSION FALLS WITHIN AN EXEMPTION IN 18.2-287.4:1(C)

I'm concerned that when "configuring" this firearm as an SBR, it will be considered "making" it by VA and is thus banned under the AWB.. Even though it existed prior to july 1 2026? So I feel that I'm in a bit of a trap here since the NFA didn't approve it prior to july 1 2026?

I should add that this is going under a trust. It didn't exist in the trust prior to july 1 2026, and will need to be added to the trust after it's been configured.

I’m heavily considering getting my first suppressor (Huxwrx flow 556 TI), and the rifle I want to host it on is a 14.5 p/w with a warcomp currently installed. Any good gunsmiths in NOVA that can take off the current p/w muzzle device and p/w a new huxwrx flash hider?

I’ve done some research and came up with the below. If you have experience with any of the ones I listed, or would like to recommend an organization not on my list, I’d love the feedback. I’m trying to stay local but will consider options where I ship the upper if that’s the best route.

Local NOVA options:

1) Sterling Arsenal. I know from past experiences that their services are pricey.

2) Middletown Firearms (Dan Mumaw). Don’t know much about this shop, but found a few threads saying Dan was good.

Non-local options:

1) D.wilson Manufacturing

Buried near the end of the plaintiffs’ new 58-page filing is a July 9 email from the Virginia Attorney General’s Office.

The OAG says that because Washington County already issued a statewide injunction, Lancaster does not need to expand its narrower injunction beyond the Virginia State Police. The email then says:

“We will not be appealing the Washington County injunction during the pendency of any stay.”

At the same time, the OAG wants the Lancaster case paused until SCOTUS decides Viramontes, rather than allowing it to move toward summary judgment and a final ruling under the Virginia Constitution.

My reading is that the OAG is willing to leave the temporary statewide injunction in place because the alternative could be worse for them: Lancaster could reach a permanent judgment striking down additional parts of the law, including the magazine, handgun, shotgun and public-carry restrictions that Viramontes may not decide.

There could also be a political or appellate benefit to delaying the case beyond January 31, 2027, when Justice D. Arthur Kelsey’s current Supreme Court of Virginia term ends. But that part is only a theory—the OAG filing does not say it is waiting for a change in the court’s membership.

The plaintiffs oppose the delay and argue that their case is already close to being resolved through summary judgment.

The ruling against New Jersey’s assault weapons ban is likely only the first, and could mark the beginning of the end for similar laws in nearly a dozen states. 

Even if Democrats retake either or both chambers in 2026, or the White House in 2028, the issue is likely to remain on the back burner. Assault weapons bans haven’t even been adopted in every reliably blue state — only 11 states and Washington, D.C., have them. 

It’s unclear whether rescinding the bans will cause an increase in gun violence — or mass shootings in particular

Mass shootings are a comparatively rare phenomenon, amounting to about 1 percent of all shootings, 3 percent of deaths from shootings, and 6 percent of shooting injuries since 2014.

The Supreme Court’s 2022 decisionin New York State Rifle & Pistol Association v. Bruen was likely the death knell for assault weapons bans.

If the Supreme Court strikes down assault weapons bans nationwide next year, states could try other strategies, including putting semiautomatic rifles behind a permitting process.
