Do you know what hemp is?

It's all the same plant. The government just has this random line they drew to differentiate between hemp and "Marijuana" (dumb word). If the cannabis plant has over 0.3% Delta-9-THC its "Marijuana", if it's under that amount it's considered hemp. Technically they also require you to be licensed for it to be considered hemp but whatever.

People deny this for some reason but it is true. If you ever look at a COA from a dispensary it will show that most cannabinoids are thca and maybe around 1% Delta 9. The thca carboxylates into Delta 9 when it's burned

mostly true. thc based flower is thca until activated, but doesn’t have to be by smoking. and cbd flower still contains thca

Don't you just have to slightly bake them between 60 and 90°c or am i remebering wrong from my baking with weed days ? (you need to do that before making butter / putting weed in food IIRC)

Look at the levels of thca vs delta 9 thc on the back of any container you get from a dispensary and get back to us lol. Most of the total thc is (surprise!) thca. Most of it doesn't become delta 9 until it is activated (heated or burned)

Thca weed and dispensary weed are literally the same exact thing, one is just sold with different marketing or labeling or whatever you wanna call it so that it can be sold legally through a loophole in the law that they are currently working on closing

Definitely depends on the state, but probably not, and it'll be tough.

Many states have started counting "total THC" instead of just delta-9-THC. There's also a pretty widespread problem with "hot hemp" where the product originally tested as hemp (below 0.3% delta-9-THC by weight) but by the time it's gotten to the store or your house it's already naturally decarbed enough THCa into THC that it'll test positive as marijuana not hemp.

Now, if you actually have a hemp product that is THC/THCa free, you can probably get test results that'll clear you. But if your hemp has THC/THCa it's likely going to be treated as if it's marijuana and they can probably get test results showing it's above that 0.3% THC by weight.

Nope it's not that simple because it's in a legal grey area. These companies have licenses to sell this stuff, so it's legal to buy, but getting caught with it in an illegal state by your local police is different. They'll just say it's weed (because it is) and good luck getting them to test it for thca content. They're just going to charge you with it and call it a day. If it gets caught in the mail though you should have no issues because they come packed with a legal disclaimer with their legitimate business information and all that

I'm not a lawyer, I guess you could try but you might end up just shooting yourself in the foot because a lot of the weed being sold as thca actually contains over the legal amount to still be considered hemp. There's ways they can kinda fudge the numbers on those tests, and nobody is testing it after it's being packaged up and sent out and they know that.

A lot of it may start out at the legal levels but as it sits a bit the thca slowly converts into delta 9, so it may have been legal at the time of testing, but by the time people are receiving it, it may not be. So you can see why it's a very dubious grey area and why they are unfortunately working on closing the current loophole
