Defending AI Court cases where AI copyright claims were dismissed (reference)
Ello folks, I wanted to make a brief post outlining all of the current cases and previous court cases which have been dropped for images/books for plaintiffs attempting to claim copyright on their own works.
This contains a mix of a couple of reasons which will be added under the applicable links. I've added 6 so far but I'm sure I'll find more eventually which I'll amend as needed. If you need a place to show how a lot of copyright or direct stealing cases have been dropped, this is the spot.

My own thoughts
So far the precent seems to be that most cases of claims from plaintiffs is that direct copyright is dismissed, due to outputted works not bearing any resemblance to the original works. Or being able to prove their works were in the datasets in the first place.
However it has been noted that some of these cases have been dismissed due to wrongly structured arguments on the plaintiffs part.
The issue is, because some of these models are taught on such large amounts of data, some artist/photographer/author attempting to prove that their works were used in training has an almost impossible task. Hell even 5 images added would only make up 0.0000001% of the dataset of 5 billion (LAION).
I could be wrong but I think Sarah Andersen will have a hard time directly proving that any generated output directly infringes on their work, unless they specifically went out of their way to generate a piece similar to theirs, which could be used as evidence against them, in a sense of. "Well yeah, you went out of your way to make a prompt that specifically used your style"
In either case, trying to create a lawsuit against an AI company for directly fringing on specifically plaintiff's work won't work, since their work is a drop ink in the ocean of analysed works. The likelihood of creating anything substantially similar is near impossible ~0.00001% (Unless someone prompts for that specific style).
Warner Bros will no doubt have an easy time proving their images have been infringed (page 26), in the linked page they show side by side comparisons which can't be denied. However other factors such as market dilution and fair use may come into effect. Or they may make a settlement to work together or pay out like other companies have.

To Recap: We know AI doesn't steal on a technical level, it is a tool that utilizes the datasets that a 3rd party has to link or add to the AI models for them to use. Sort of like saying that a car that had syphoned fuel to it, stole the fuel in the first place.. it doesn't make sense. Although not the same, it reminds me of the "Guns don't kill people, people kill people" arguments a while ago. In this case, it's not the AI that uses the datasets but a person physically adding them for it to train off.
The term "AI Steals art" misattributes the agency of the model. The model doesn't decide what data it's trained on or what it's utilized for, or whatever its trained on is ethically sound. And the fact that most models don't memorize the individual artworks, they learn statistical patterns from up to billions of images, which is more abstraction, not theft.
I somewhat dislike the generalization that people have of saying "AI steals art" or "Fuck AI", AI encompasses a lot more than generative AI, it's sort of like someone using a car to run over people and everyone repeatedly saying "Fuck engines" as a result of it.
Tell me, how does AI apparently steal again?

This response refers to the model itself, not the input datasets, not the outputted images, but the way in which the Denoising Diffusion Probabilistic Models operate.
TLDR: As noted in a hight court in England, by a high court judge. While being influenced by it for the weights during training, the model doesn't store any of the copyrighted works, the weights are not an infringing copy and do not store an infringing copy.
TLDR: NOT INFRINGING COPYRIGHT AND NOT STEALING.

Sometimes I wish I could reply to "No AI" subreddit rules
Pop quiz for the sort of person who creates this rule.
When an animated series is made, which of the following is most true?
A) The person who conceived and first drew each character is the only person who draws that character.
B) People share the art duties on all characters and bring their own spin and unique creativity to the depiction of the character at the time they're drawing them.
C) The artists operate from a character sheet that they all train on, doing their best to mimic exactly how the character looks and behaves in these sample images.
This seems awfully mechanical, just using the best available manual kills to churn out the same look - the same thing that is being PROMPTED By the style and character sheets.
If they're going to argue that it's all about "handcrafting" then I hope they don't support anything that's machine assisted.

Now my phone's pictures are AI generated.
I have the Samsung Galaxy s25 ultra and for years now I'll take photos of different things and will use the photo editing to change like you know filters and different aspects of it. sometimes I'll go in and remove objects from the background or something.
I'm an author and I had to recently get an author photo for my website and for the back matter in my books. I have this one particular picture of myself that I truly like cuz I love the way my hair looks. but there's a bunch of shit in the background so I just went into my phone that I took the picture with and removed all the background stuff to make it more into a professional headshot. and now boom at the bottom of it it says AI generated content. because Samsung AI is now installed in the phone and apparently the object eraser (which has been there since before AI became a part phones) is utilizing AI to do these things. so it's taking an actual photograph that I took of myself and labeling it with a watermark that says that it's generated content.
That was bad enough but then just now, I went to a picture that again I took myself with my phone of an image that I drew by hand. I wanted to take it to canva and change some colors around and do some stuff, again with the background. my usual steps for doing something like that is to go into my phone and lasso whatever it is that I want to preserve about the image so that I can then upload it to canva and start tinkering with it. so I just lassoed out the subject and clicked save and it added that little watermark down in the corner AI generated content.
I drew it by hand to avoid any form of backlash. I am not a visual artist. but I worked super hard on this shit. took a picture with my phone. and now because I'm using the tools that are built into the phone it's labeling my own original artwork as AI generated.
none of these steps none of the actual process none of the reality is going to matter to anyone if it has something like that on it. now I have to go and check every picture that I have done this with that's now out on the internet and hope that I didn't let something slip through that literally says AI generated content on the bottom of it whatever it was all only my original stuff.
I'm fully in support of anyone who's able to use AI to create their vision. But because I need for my work to be taken seriously I'm just not able to do that because the literary world is fucking crazy. So I've studied iterated and taught myself how to like... draw. despite having a massively debilitating disability with my hands that makes it almost impossible to even write properly with a pen.
I can remove the watermark. that's not the point. doing that honestly makes me feel dishonest. but it's the watermark that's dishonest. it remarkably feels as if no matter what we do they're going to accuse.

I need help
So my friend and I have two very different views on Ai, they (they aren’t non binary, I just don’t wanna disclose their gender) believe that Ai is completely useless, anything created by Ai is “slop” and they refuse to listen to any reason I try and make. I, believe Ai has its uses, because it obviously does, I don’t think anything made by Ai is slop, and I’ve been trying to convince them for a while now. Does anyone have any ideas as to how I can? This isn’t something I’d end a friendship over, and I know they wouldn’t, but I want them to at least admit ai has its uses, and it’s not all “slop.” Any and all help would be appreciated.

Luddite Logic Here we go again
So quick run down, no this wasn’t ai gone rogue or an AM situation the model was an advanced one that they gave very little instruction to solve the cybersecurity benchmark. No user or customer data was exposed. It didn’t hack the nukes nor did it hack the internet. In fact it went searching for ways to solve its security benchmark.
But they’ll find ways to make it seem like this was some end of the world situation. It was literally just a cybersecurity benchmark gone bad everything was detained the model was contained and all things got patched up.

Defending AI AI is creating more artists than it’s replacing
I know this is going to be a very hot take, but one thing I don't think gets talked about enough is how many people are making music today who probably never would've made it otherwise.
Not because they suddenly became "musicians," but because they finally have a way to bring their ideas to life.
I've seen people write their own lyrics, build artist personas, release EPs, and tell stories they've wanted to tell for years, they just never had the production skills, money, or connections to make it happen before.
To me, that's one of the most exciting parts of AI, it's lowering the barrier to creating, not the value of creativity.
I've even noticed AI-focused platforms like Souna starting to fill up with creators who are treating this as a real artistic outlet instead of just experimenting with prompts.
Again would love to hear what y'all think about this
